YourKendra — Acceptable Use Policy

You agree not to use the Service for any of the following:

1. Illegal activity

- Violating any federal, state, or local law - Facilitating fraud, money laundering, or deceptive practices - Impersonating others - Infringing intellectual property rights

2. Spam and unauthorized outreach

- Sending email or SMS in violation of TCPA, CAN-SPAM, or applicable state statutes - Outreach to recipients without proper consent - Outreach to recipients on the National Do Not Call Registry without a valid business relationship - Using our Service to send political robocalls

3. Harassment or abusive content

- Threats, harassment, hate speech, stalking - Content that incites violence - Content sexualizing minors

4. Regulated-industry misuse

- Medical diagnosis or treatment advice unless licensed and compliant with HIPAA - Legal advice unless licensed - Financial or investment advice unless registered with SEC/FINRA - Mortgage, insurance, or credit decisions unless properly licensed

5. Healthcare (HIPAA)

⚠ Lawyer review required: we are NOT currently HIPAA-compliant. Customers in healthcare cannot use us for PHI until we sign a BAA. Confirm explicit ban is sufficient.

Until YourKendra completes HIPAA certification + signs Business Associate Agreements, you will not send Protected Health Information (PHI) through our Service.

6. Impersonation and fraud

- Using Kendra, Marcus, or any employee to impersonate a real person without authorization
- Using voice cloning to impersonate anyone without their explicit consent
- Using AI-generated content to deceive recipients about its origin

7. Upstream AI-provider terms

Our Service uses Anthropic Claude and OpenAI GPT-4o. You may not use our Service in violation of:
- Anthropic Usage Policies
- OpenAI Usage Policies

8. Infrastructure abuse

- Circumventing rate limits
- Scraping our Service
- Reverse engineering
- Accessing accounts that aren't yours

9. Consequences

Violations may result in:
- Warning + required remediation (first minor violation)
- Suspension pending review (moderate violation)
- Immediate termination without refund (severe violation, illegal activity, or repeat offense)

We will cooperate with law enforcement on reasonable, lawful requests.

10. Report abuse

Email abuse@yourkendra.com with details. We investigate every report.
